By accessing or using DreamTales ("the Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.
2. User Accounts
To access certain features of the Service, you may need to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3. User Content
You retain ownership of any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content, you grant DreamTales a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content for the purpose of providing and improving the Service.
4. User Responsibility and Liability
You are solely responsible for any content you create, submit, or share through the Service. DreamTales does not endorse, support, represent, or guarantee the completeness, truthfulness, accuracy, or reliability of any user-generated content. You agree that DreamTales cannot be held liable for any content generated through the use of the Service, and you assume full responsibility for any consequences arising from the content you create or share.
5. Prohibited Conduct
You agree not to use the Service for any unlawful, infringing, or harmful purposes. This includes, but is not limited to, posting illegal, obscene, or defamatory content, infringing on intellectual property rights, or interfering with the operation of the Service.
6. Payment and Subscriptions
Some features of the Service may require payment. By purchasing a subscription, you agree to pay the applicable fees. Subscription charges are non-refundable, and no refunds will be provided for any unused portion of a subscription period.
7. Intellectual Property
The Service and its original content, features, and functionality are owned by DreamTales and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. The ownership of any content generated through the use of DreamTales's AI-powered tools remains with the user who created it. However, by using the Service, you grant DreamTales a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content for the purposes of improving and promoting the Service.
8. Third-Party Services
The Service may contain links to third-party websites or services that are not owned or controlled by DreamTales. DreamTales has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services.
9. Termination
DreamTales may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms. If you wish to terminate your account, please contact support or use the self-serve options in the product's account settings. Upon requesting to delete an account, all Content from such account will immediately become inaccessible. After 30 days, the Content (including your User Content) will be deleted from our servers and can no longer be recovered.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis. DreamTales makes no representations or warranties of any kind, express or implied, as to the operation of the Service or the information, content, materials, or products included on the Service.
11. Limitation of Liability
In no event shall DreamTales, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any content obtained from the Service; and (d) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.
12. Indemnification
You agree to defend, indemnify, and hold harmless DreamTales and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, by you or any person using your account and password; (b) a breach of these Terms; or (c) your User Content provided to the Service.
13. Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without giving effect to any principles of conflicts of law.
14. Changes to the Terms
DreamTales reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
15. Arbitration and Class Action Waiver
Any dispute, controversy, or claim (collectively, “Claim”) relating in any way to your use of DreamTales services and/or products, including the Service, will be resolved by arbitration. You and DreamTales agree that any Claim will be settled by final and binding arbitration, using the English language, administered by JAMS under its Comprehensive Arbitration Rules and Procedures (the “JAMS Rules”) then in effect. Arbitration will be handled by a sole arbitrator in accordance with the JAMS Rules. Judgment on the arbitration award may be entered in any court that has jurisdiction. Any arbitration under these Terms will take place on an individual basis – class arbitrations and class actions are not permitted. By agreeing to these Terms, you and DreamTales are each waiving the right to trial by jury or to participate in a class action or class arbitration.

Refund Eligibility
1. Service Usage: No refunds will be provided once you have used any portion of the services included in your purchased plan, including AI credits.
2. As-Is Service: DreamTales provides its services "as is" and does not issue refunds based on subjective satisfaction, writing quality, or specific expectations not being met.
3. Trial Period: If you cancel the service during a trial period and have not used any paid services, you will not be charged.
4. Technical Issues: If you experience verified technical issues that prevent you from using the services and DreamTales is unable to resolve them within a reasonable timeframe, you may be eligible for a refund.
5. Billing Errors: If there has been a confirmed billing error, such as duplicate charges or being charged for a service you did not purchase, you are eligible for a refund of the erroneously charged amount.
Requesting a Refund
To request a refund, please contact our customer support team at [email protected] with your account details and a clear explanation of the issue. Refund requests will be assessed based on the eligibility criteria outlined above.
Processing Refunds
Approved refunds will be processed within 7-10 business days back to the original payment method. You will receive an email notification once the refund has been initiated.
Non-Refundable Circumstances
Refunds will not be provided if:
- You have used any of the services included in your plan after purchase.
- You are dissatisfied with the output of the services or have changed your mind.
- Your account is terminated due to a violation of our Terms of Service.
Subscription Cancellation
If you cancel your subscription, you will continue to have access to the Service until the end of your current billing period. No refunds will be provided for the remaining time in the billing period.
Chargebacks
If a chargeback is initiated against a payment made to DreamTales, your account may be immediately suspended or terminated. In the event of a chargeback, you agree to pay any fees associated with the chargeback and provide necessary documentation to resolve the dispute.
Refund Exceptions
In exceptional circumstances, such as a major service outage or extended downtime, DreamTales may, at its sole discretion, offer prorated refunds or service credits to affected users.
Abuse of Refund Policy
DreamTales reserves the right to refuse refunds or terminate accounts if it suspects abuse of the refund policy, such as excessive refund requests or attempts to exploit the policy for financial gain.
Policy Modifications
DreamTales reserves the right to modify this refund policy at any time. Any changes will take effect immediately upon updating the policy on our website.
